Uncontested Divorce
An uncontested divorce is a type of divorce where both parties agree on all the major issues involved in the separation. This typically includes the division of property, alimony, child custody, child support, and any other relevant matters. Because both spouses agree on these terms, the process tends to be faster, simpler, and less costly compared to a contested divorce.
They are less adversarial and often involve fewer legal battles, however, it's important for both parties to fully understand their rights and responsibilities before finalizing an agreement. Just like a divorce which goes to trial, the terms of the final Divorce Decree will be legally binding and may have long-term effects on their lives.
Paternity
A paternity action is a legal process used to establish or dispute the fatherhood of a child. This action is often pursued when there is a question about who the legal father of a child is, or when a father seeks to establish his parental rights and responsibilities. It can also involve issues of child support, custody, and visitation.
A paternity action is a significant legal process that ensures the rights and responsibilities of parenthood are clearly defined and enforced. Whether seeking to establish or contest paternity, understanding the legal procedures and implications is crucial for all parties involved.
Guardianship
Guardianship is a legal relationship established by a court where one person (the guardian) is given the authority and responsibility to make decisions for another person (the ward) who is unable to make those decisions for themselves. This arrangement is often used in situations where the ward is a minor or an adult who is incapacitated due to age, disability, or illness.
Guardianship is a serious responsibility that requires the guardian to act in the best interests of the ward and adhere to legal and ethical standards. If you're considering becoming a guardian or need to address guardianship issues, consulting with a legal professional can provide guidance tailored to your specific situation.
Temporary Restraining Order
A Temporary Restraining Order (TRO) is a legal order issued by a court to provide immediate protection to an individual who alleges that they are facing imminent harm or threats from another person. A TRO is typically used in situations involving domestic violence, harassment, stalking, or threats, and it is designed to offer short-term relief while the court assesses the need for a longer-term solution.
As a law firm we both file TROs when they are necessary, and defend against them when they shouldn't have been filed in the first place.
Contested Divorce
A contested divorce is a type of divorce in which the spouses cannot reach an agreement on one or more key issues related to their separation. Unlike an uncontested divorce, where both parties agree on terms such as asset division, child custody, and support, a contested divorce involves disagreements that require resolution through legal proceedings.
Reasons for Contention Include:
- Asset Division: Disputes over how marital property and debts should be divided.
- Child Custody and Visitation: Conflicts over who will have physical and legal custody of the children and the terms of visitation.
- Child Support: Disagreements about the amount and terms of financial support for the children.
- Spousal Support (Alimony): Disputes over whether alimony should be paid, and if so, how much and for how long.
- Other Issues: Disputes may also involve matters such as the division of retirement accounts, personal property, or debts.
